There are very limited circumstances when costs can be ordered to be paid by the losing party but normally the losing party does not pay the legal costs of the winning party. Fees have now been introduced for issuing proceedings, and for hearings. Such fees may be recoverable from the losing party. An employee’s financial circumstances may result in a remission from fees being granted.
