We acted regarding a commercial loan dispute, looking at whether the company or an ex-director of the same company owed £50k.

A married couple allegedly lent a now ex-company director this significant sum of money. The company he was a director of is now accused of being a joint debtor on the basis of an alleged promissory note signed by a present company director. The co-defendants are arguing over who is liable to repay the loan. The matter is ongoing and is at Directions stage and will be put on the multi-track of the County Court shortly. The matter may require the involvement of a forensic accountant to track the journey of the loan monies which were allegedly paid into a company account by the ex-Director without the other directors’ knowledge.
