This matter was a neighbour dispute. The clients’ neighbours approached our client and asked if they could replace the rear garden dividing fence which our client’s paid for and erected a few years ago. Our clients refused, which meant the neighbours erected their own fence approximately 4 inches from our client’s fence.

Our clients then erected a shed in their garden, right up to the existing fence, taking two panels of the shed out, to slot the shed into.

The neighbours have sent a pre-action letter to our clients and negotiations have been taking place since. Our clients have obtained their own expert evidence on where the rear boundary fence should be, and we await the response of the neighbours’ solicitors.

No direct financial value although the amenity of our clients’ property is at stake.
