Property Disputes – Neighbour Dispute

How we helped

This was a neighbour/easement dispute. The clients have always exercised their rights over an estate after being the first to purchase from the estate, and years later, buying the freehold. New neighbours moved in, in 2015/2016, and have recently prevented our clients from accessing the side of their garden as they have always done, resulting in police involvement.

It has been an extremely difficult time for the clients who are in their 60’s and are having to deal with someone much younger and quite aggressive who is now trying to prevent them from accessing their flower bed at the side of their property.

A lengthy letter was sent to the neighbour, and as 4 months passed without a response, an application has been made to the Land Registry to register the clients’ rights against their title. Since, an offer letter has been received from the solicitors acting for the neighbour and we are now taking client’s instructions.

Value

No direct financial value although the amenity of our clients’ property is at stake.
