The Transfer of Undertakings (Protection of Employment) Regulations can apply to outsourcing and contracting arrangements, so that a business taking over a contract from a previous service provider can find itself having to employ staff of the previous service provider, where those employees’ principle purpose was carrying out the service for the client.

The Regulations are complicated and advice should be taken.
