There are very limited circumstances when costs can be ordered to be paid by the losing party but normally the losing party does not pay the legal costs of the winning party.

Fees had been introduced for issuing proceedings, and for hearings. Such fees had the effect of drastically reducing the number of claims being taken to Tribunal. However, such fees were determined by the Supreme Court to be discriminatory and have now been abolished. As such we are now experiencing a significant increase in the number of claims being made.
